The study begins with the recognition that, while such clauses play an important role in protecting business interests and contractual loyalty, their misuse may impose abusive restrictions on workers’ professional freedom and dignity. The lack of specific legislation on the matter within Brazilian labor law increases legal uncertainty, delegating to doctrine and case law the responsibility of defining parameters of validity, such as reasonable temporal, territorial, and material limits, as well as fair financial compensation. Methodologically, this is qualitative and exploratory research based on bibliographic and documentary. The study concludes that these clauses must respect the balance between business protection and workers’ rights, guided by the principles of good faith, social function of contracts, and professional freedom. As an original contribution, the research presents a Draft Law Framework on non-compete and confidentiality clauses, attached as Appendix A, aiming to support future legislative developments and provide greater legal clarity. To this end, its general objective was to identify the narratives and actors that influenced the debate on the reduction of working hours related to occupational health on social media during the first five months of 2026. The study was based on Labor Law norms regarding the regulation of working hours and used accounts of historical struggles and demands as examples of material sources within this legal field. A discussion concerning the tensions between capital and the necessary rest time, existential damage, and the time required for workers to experience their physical, mental, social, political, cultural, family, and spiritual needs formed a dialogue about workers’ right to health and exhausting work schedules. Next, the potential of digital environments for the construction of contemporary legislative proposals was debated, such as Proposed Constitutional Amendment (PEC) n. 8/2025, which was influenced by the viral video of former pharmacy clerk Rick Azevedo, currently a city councilor in Rio de Janeiro and founder of “Vida Além do Trabalho” (VAT), in english Life Beyond Work. With this theoretical framework, the research employed the hypothetical-deductive method in a mixed-methods approach, using Content Analysis to collect and process data from social media posts that mentioned the 6x1 schedule issue. Data collection was carried out using a Social Listening tool, Stilingue, and considered the platforms Instagram, X, and Facebook within the timeframe of January 01, 2026, to May 31, 2026. The total volume collected was 147,733 posts, and to categorize the data, a qualitative sample representing high engagement relative to the total volume was extracted. The results demonstrated broad positive support for the proposal to end the 6x1 schedule without a salary reduction, with a favorable index in 89% of the posts and 88% of the engagement. Economy and Health emerged as the main themes, while Congresswoman Érika Hilton (PSOL-SP), President Lula, Mídia Ninja, and Congressman Nikolas Ferreira (PL-MG) were among the most influential profiles in the debate. The research verified that the mediums for labor mobilizations have adopted new technologies. The old printed pamphlets are now published on digital networks, but the demands for "salary" and "working hours" remain central to the claims. For workers, having time means having a life. The justification for this work is based on the observation that schools, although essential spaces for the development of social, cultural, and ethical values, also reflect the conflicts, prejudices, and exclusionary practices present in society. The identified issue refers to the prevalence of punitive approaches, which often exacerbate tensions and hinder the teaching learning process, instead of fostering dialogue, active listening, and damage repair. The methodology adopted is qualitative, involving a literature review and field research consisting of semi-structured interviews with the mediation and conciliation team of the João Pessoa (PB) Municipal Guard. Among the main results, it is highlighted that the implementation of school mediation significantly contributes to building a more respectful, empathetic, and collaborative environment, favoring conflict prevention and the promotion of citizenship. The data collected in the interviews corroborate the information presented in the bibliographic references, considering that, in the approach used in the project, mediation is conducted by the students themselves, ensuring the strengthening of autonomy and independence to act in conflict resolution. It is concluded that mediation and conciliation practices in the school context not only resolve immediate conflicts but also strengthen the culture of peace, inclusion, and the development of socio-emotional skills, highlighting their transformative nature for the entire educational community. The main objective of this research is to examine, in this specific case, the obstacles to accessing these rights and how strategies used by the Brazilian social security system influence the increase in violence and social exclusion among artisanal fishers. Initially, through a bibliographic and legislative survey, the research explores the historical, social, and legal context of artisanal fishing in Brazil, addressing key moments, such as the recognition of this category as special insured persons under the General Social Security Regime (RGPS), highlighting the progress made since then and, especially, the challenges faced. To portray this challenging scenario, the monograph begins with a case study of Mariana (fictitious name), a shellfish gatherer from the city of Pitimbu, Paraíba, whose journey highlights the various barriers imposed on those who, like her, work informally in traditional communities and fight for the recognition of their rights. Therefore, this is a qualitative and exploratory study, with bibliographic and documentary analysis and a concrete case study of Mariana.The study is analyzed through accounts, interviews, and documents collected and also provided by research and extension groups at the Federal University of Paraíba, which have been monitoring the shellfish gatherer in this social security context. From this, it becomes possible to understand the strategies used to deny rights within the Brazilian social security system, how the justice system has been handling the situation, and how this has impacted the lives of affected workers, such as the barriers imposed to proving special insured status and the frequent humiliations during medical evaluations.
