Maioridade Penal: Análise sob a égide dos aspectos jurídicos e sociológicos na realidade brasileira

Abstract

This study seeks to analyze whether or not it is necessary to reduce the criminal majority, making a brief history of the legislation on the subject in Brazil, presenting the current legislation and analyzing, according to official data, how the Brazilian state cares for adolescents who are commit infringing acts. An evaluation of the legislation will be made with comparative law. We will also make an analysis of the legislation, from the sociological perspective on the incompleteness of adolescent education, in order to define whether or not criminal age in Brazil deserves to be modified, more precisely, given the growing demand of the population and congressmen to understand. As an effective measure in combating the increasing violence, the reduction of the legal age of to this end, the arguments will be presented in favor and against the reduction of the age of penal, seeking to eliminate any distortions and passions employed in the speech, but little or nothing based on scientific data. Finally, by contrasting with other areas of law, such as civil, labor and electoral, we can conclude on whether or not it is necessary to reduce the criminal majority and its effects on the young population of this nation.
