“Pornografia de vingança”: a nova face da violência de gênero na era tecnológica e o dilema de sua criminalização

Abstract

This work of completion of course aims to study the phenomenon of pornography of revenge, characterized by the exposure of vídeos, photos or other audiovisual record that contains third-party nudity scenes. It initially brings a sociological analysis of patriarchy as a defining role of the woman of submission. It then considers the profile of the victims, as well as the analysis of consequences that the pornography of vengeance entails in their lives through the analysis of reports. It also lists the laws related to the theme, as well as the draft laws in the National Congress and also criminal and civil jurisprudence, about the matter to exemplify the discourse of magistrates who decide this issue. Subsequently, it examines article 218-C, of the penal code, that was introduced by law n.13.718/2018. At the end, a criticism of the criminalization is of the theme because it understands that the criminal justice system despite being a means of guardianship is not sufficient to combat the problem at its origin. In synthesis, such conduct gained strength with the advent of technology and, creation of sociais networks and through the study and analysis of data made available in surveys it is concluded that the pornography of vengeance, in which the large part of the victims are women, began to signify a new model of gender violence. The results were achieved through qualitativequantitative research, by means of bibliographic analysis of books, and articles, texts and other materials; documentary scientific characteristic through studies and draft laws; and case analysis practical.
