Análise comparativa entre programas governamentais de habitação: Programa Minha Casa Minha Vida e programa Casa Verde e Amarela sob uma perspectiva jurídica

Abstract

The right to housing is a fundamental precept necessary for the dignified existence of human beings. As this is a comprehensive issue in Brazil, housing programs have emerged with the aim of addressing the country's growing housing deficit. However, in general, these programs have been insufficient and have had fewer resources than necessary. Faced with this fact, this paper aims to critically analyze housing programs in Brazil, focusing on housing policy and its relationship to the right to adequate housing. The study focuses on two recent initiatives: Minha Casa Minha Vida, created by Law N º 11,977/2009, and Casa Verde Amarela, established by Provisional Measure N º 996/2020 and later converted into Law N º. 14,118/2021. Using a dialectical, historical-legislative, and comparative approach, the paper identifies the main elements of these programs, including their changes, innovations, and critiques. Furthermore, the paper investigates the influence of the capitalist system in this context, seeking to understand how market logic affects housing policy and its social and urban dimensions, particularly regarding the right to the city. Based on this analysis, it examines whether these programs effectively meet the specificities outlined by legislation, especially in terms of providing support to the most vulnerable groups. In the context of the growing housing deficit in the country, this research aims to contribute to a deeper understanding of the most recent housing programs, highlighting their limitations and challenges, as well as proposing possible improvements. By critically examining these initiatives, the aim is to provide relevant insights for the formulation of more effective and inclusive public policies, with the goal of ensuring the right to adequate housing for all Brazilian citizens.
