| Título: | A condição jurídica do nascituro: teoria concepcionista e a tutela dos direitos da personalidade |

| Resumo: | O nascituro que é a pessoa que ainda está por nascer, já carrega desde à concepção material genético próprio que anuncia a sua natureza humana, o que lhe atribui, por conseguinte, existência de vida e de pessoa. Ainda desamparado no Direito brasileiro, não sendo reconhecido de forma integral a sua condição de pessoa, o nascituro por vezes é ignorado na esfera jurídica, tendo assim os seus direitos mais básicos desassistidos. O presente trabalho versa sobre o início da personalidade jurídica desde a concepção, ocorrendo, por consequência, a proteção do nascituro, que desde o momento em que é concebido, já é titular de direitos da personalidade, quais sejam, o direito à vida, à honra, ao nome, à imagem, e à integridade física e psíquica. Todos estes são direitos fundamentais para o respeito da dignidade da pessoa humana, e para o cumprimento do ordenamento constitucional, sendo imprescindível o seu reconhecimento para as pessoas ainda não nascidas. Este trabalho tem como objetivo delimitar os direitos do nascituro dentro do ordenamento jurídico brasileiro, a partir da defesa da teoria concepcionista.e do reconhecimento de condição humana ao nascituro, reconhecendo-lhe a tutela dos direitos da personalidade. |
| Abstract: | The unborn child, who is still to be born, already carries from the very conception of his own genetic material that announces his human nature, which therefore attributes to him the existence of life and person. Still helpless in Brazilian law, not being integrally recognized as a person, the unborn is sometimes ignored in the legal sphere, thus having their most basic rights unassisted. The present work deals with the beginning of the legal personality from the moment of conception. Consequently, the protection of the unborn child, which from the moment in which it is conceived, is already the holder of personality rights, namely, the right to life, Honor, name, image, and physical and mental integrity. All these are fundamental rights for the respect of the dignity of the human person, and for the fulfillment of the constitutional order, being indispensable its recognition for the people not yet born. This work aims to delimit the rights of the unborn within the Brazilian legal system, from the defense of the conception theory and recognition of the human condition to the unborn child recognizing the protection of the rights of the personality. |
