| Título: | Uma análise sobre a Lei Nacional de Adoção |

| Resumo: | O propósito deste trabalho monográfico é analisar as regras da Lei nº 12.010/09, procurando compreender sua aplicabilidade no ordenamento jurídico brasileiro, principalmente pelo ponto de vista das milhares de crianças e adolescentes que esperam por anos nas entidades de acolhimento, sendo desrespeitados, portanto, alguns dos princípios básicos, como o da Dignidade Humana, fundamentado na Constituição Federal, e o do Melhor Interesse da Criança e do Adolescente. Além das diversas doutrinas e artigos científicos que versam sobre o assunto, jurisprudências também serão utilizadas, para que seja possível analisar se os direitos da criança e do adolescente vêm sendo respeitados. Um dos objetos de pesquisa a serem utilizados serão os relatórios disponibilizados pelo Conselho Nacional de Justiça, que mostram a realidade dos perfis mais escolhidos entre os adotantes, ou seja, os perfis preferidos entre aqueles que querem adotar uma criança ou adolescente. Consoante ao exposto, conclui-se que a adoção deve ser feita sempre visando o melhor interesse das crianças e adolescentes, para garantir que elas tenham famílias que lhes dê afeto e conforto, e que possam ser educadas para seguir valores primordiais da sociedade durante seu período de desenvolvimento para terem oportunidades no futuro. |
| Abstract: | The aim of this monographic paper is to analyse the provisions of the Law n. 12.010/09, seeking to understand its applicability in the Brazilian legal order, mainly from the point of view of thousands of children and adolescents who have been waiting for years in host entities to be adopted. This demonstrates that basic principles, such as the Human Dignity, whose foundations rest on the Federal Constitution, and the Best Interest of the Child and Adolescent, are being disrespected. Besides the various doctrines and scientific papers dealing with the subject, another method also used in this study was case law, in order to make it possible to analyse if the rights of children and adolescents are being respected or not. One of the utilised research objects were the reports of the National Council of Justice, which show the reality of the most chosen profiles among adopters, that is, the preferred profiles among those who desire to adopt a child or adolescent. In accordance with the exposed, we conclude the adoption must always be carried out taking into consideration the best interest of the children and adolescents, to ensure they have families who provide them with affection and comfort, and that they are grown to follow the primordial values of the society during their development period. This will give them opportunities in the future. |
