| Título: | Direitos reprodutivos e planejamento familiar: a influência das novas tecnologias de reprodução assistida |

| Resumo: | O presente trabalho analisa o gozo de direitos reprodutivos no exercício do poder familiar e da influência das novas tecnologias de reprodução assistida, à luz da Bioética e do Biodireito. Desta maneira, torna-se imprescindível ressaltar os conceitos e generalidades acerca da Bioética e do Biodireito, além dos princípios direcionadores dos mesmos, compreendendo que a Constituição Federal de 1988 prevê que o planejamento familiar está dentro da realidade social e incentiva o desenvolvimento dos melhores métodos do planejamento familiar e também da paternidade responsável, por meio da limitação dos princípios constitucionais e bioéticos, retratando assim um trajeto complexo a ser percorrido. É relevante compreender os aspectos gerais e controversos no que tange a reprodução assistida, possuindo a compreensão dos direitos reprodutivos e do entendimento da Resolução nº 2.121/2015 do Conselho Federal de Medicina e suas técnicas utilizadas, evidenciando assim, que a família teve uma alteração bastante salutar, através da livre escolha de seu planejamento por meio de uma reprodução que não é tradicional, em virtude de não obter êxito pelo meio natural. Versa-se ainda sobre o planejamento familiar, com análise da Bioética, acerca das primordiais questões no que se refere à reprodução assistida, no que tange suas inovações tecnológicas, em razão do ordenamento jurídico ser omisso acerca desses avanços, deixando de tratar sobre questões de cunho relevante, como os embriões excedentários. Este trabalho tem como principal objetivo a partir de uma análise do Biodireito e da Bioética, por meio da compreensão de suas especificidades, conceitos, características, além de uma perspectiva atual da reprodução humana assistida, relacioná-la com o planejamento familiar, em razão dos avanços tecnológicos, no que se refere ao destino dos embriões excedentários, sendo imprescindível a normatização da temática em questão, para que se possa assegurar os direitos constitucionais desses seres. Este estudo foi realizado através do método de abordagem dedutivo e se desenvolveu de maneira predominante através de revisão bibliográfica e de legislação concernente à temática, assim como de leitura crítica baseada no referencial teórico bibliográfico utilizado. Portanto, a obra possui o intuito da divulgação da temática, a fim de esclarecer acerca dos direitos reprodutivos no âmbito da reprodução humana assistida, sendo válido ressaltar que mesmo que não exista legislação específica, não há interferência no que concerne a utilização da reprodução assistida. |
| Abstract: | The present work analyzes the enjoyment of reproductive rights in the exercise of family power and the influence of the new technologies of assisted reproduction, in the light of Bioethics and Biological Rights. In this way, it is essential to emphasize the concepts and generalities about Bioethics and Biological Rights, in addition to the guiding principles of the same, understanding that the Federal Constitution of 1988 provides that family planning is within the social reality and encourages the development of the best methods of family planning and also of responsible parenthood, through the limitation of constitutional and bioethical principles, thus portraying a complex path to be covered. It is relevant to understand the general and controversial aspects regarding assisted reproduction, having the understanding of the reproductive rights and understanding of Resolution No. 2.121 / 2015 of the Federal Council of Medicine and its techniques used, thus evidencing that the family had a considerable change salutary, through the free choice of their planning through a reproduction that is not traditional, by virtue of not being successful by the natural environment. It is also related to the family planning, with analysis of Bioethics, about the primordial issues regarding assisted reproduction, regarding their technological innovations, because the legal system is silent about these advances, ceasing to deal with issues of such as surplus embryos. The main objective of this work is to analyze bioethics and bioethics through the understanding of their specificities, concepts, characteristics, as well as a current perspective of assisted human reproduction, to relate it to family planning, due to the advances in technology, regarding the fate of surplus embryos, and it is essential to standardize the subject matter in order to guarantee the constitutional rights of these beings. This study was carried out through the method of deductive approach and was developed predominantly through a bibliographical review and legislation concerning the subject, as well as a critical reading based on the bibliographic theoretical framework used. Therefore, the work has the purpose of disseminating the theme, in order to clarify about the reproductive rights in the scope of assisted human reproduction, being valid to emphasize that even if there is no specific legislation, there is no interference with the use of assisted reproduction. |
