Abstract

The purpose of this study was to investigate how the existing legislation guarantees the respect and implementation of the Fundamental Rights of the elderly, presenting the challenges that the issue of aging has brought to the field of social policies in terms of ensuring the full realization of their fundamental rights. is provided for in the Federal Constitution (1988) and the Elderly Statute. As a research methodology we conducted a bibliographical study in books, documents and articles that discuss the theme. We conclude that although aging is bringing several challenges to social policies, this represents a great achievement of humanity in terms of longevity, but for the elderly to have the quality of life they need at this stage, there is a need for better investments in all areas. social policies, as well as the construction of a culture of respect for the elderly, so that the situations arising from violence that these subjects face no longer exist, since although there is protective legislation for the Elderly in Brazil, it is necessary that it be effectively applied, It is clear that this does not occur due to the lack of awareness of the population about their rights and the neglect of the Government in the implementation of more effective and effective public policies.
