Diálogos paradiplomáticos e transconstitucionais: facilitação do acesso à saúde pela integração entre os governos do Mercosul – Brasil, Argentina, Uruguai e Paraguai

Abstract

The present work intends to expose how the agreements and pacts of regional cooperation in health among the member countries of Mercosur, among them, Brazil, Argentina, Paraguay and Uruguay, allow a better access to the public health services in the border regions, with the aid of Paradiplomacy and Transconstitutionalism, ensuring the guarantee of the fundamental right to health for populations on both sides of the border line. With this, the objective is to determine the degree of relevance of the implementation of integrative measures between the governments of the countries belonging to the Mercosur bloc, driven by the objective of allowing the expansion of access to the right to health, guaranteed by the various regulations for the populations of these border regions. Furthermore, this analysis will also be made from the perspective of the phenomena of Paradiplomacy and Transconstitutionalism, which are lines of thought of extreme relevance to the constitutional sphere in its aspect of promoting fundamental rights. Through documentary and bibliographic research, an analysis and investigation will be carried out, from a paradiplomatic and transconstitutional point of view, of how the integrative and cooperative agreements between Brazil and the other Mercosur countries can promote the fundamental right to health. for their respective populations. Through the hypothetical-deductive method, the study will start from the problem of the difficulty of the populations of the border regions to enter public health services, with consequent analysis of the conjectures about the problems involved, in order to infer the best ways to arrive at the elucidation of the issues. By analyzing the importance of agreements for the promotion of the right to health; the factors that make it difficult to agree on health agreements in Mercosur's border regions with the help of paradiplomatic and transconstitutional actions; and the possible solutions to these impasses, it will be demonstrated how the joint action of the countries, in their different levels of governance, allows the promotion of fundamental human rights.
