| Título: | A importância do juiz de garantias no sistema judiciário brasileiro |

| Resumo: | O presente trabalho de conclusão de curso visa analisar de modo pragmático o papel do juiz de garantias no sistema judiciário brasileiro como concretização do sistema processual penal acusatório advindo ao longo das reformas políticas organizacionais no país, á luz da Constituição Federal de 1988. Exercendo a função de inibidor das práticas abusivas e parciais dos magistrados na fase pré-processual investigatória. Essa análise foi realizada através de uma revisão narrativa, a partir da literatura legislativa, análise jurisprudencial e doutrinária do assunto, trazendo casos práticos. No tocante à legislação, o presente estudo demonstrará sua evolução ao longo dos anos e suas nuanças. Além disso, como foi a implementação do juiz de garantias na Europa e na América Latina, como referencia para o Brasil. |
| Abstract: | The present work aims to pragmatically analyze the role of the guarantee judge in the Brazilian judicial system as a materialization of the accusatory criminal procedural system arising throughout the organizational political reforms in the country, in the light of the Federal Constitution of 1988. Exercising the function of inhibitor of practices abusive and partial decisions by judges in the investigative pre-procedural phase. This analysis will be carried out through a narrative review, based on the legislative literature, jurisprudential and doctrinal analysis of the subject, bringing practical cases. With regard to legislation, this study will demonstrate its evolution over the years and its nuances. In addition, how was the implementation of the guarantee judge in Europe and Latin America, as a reference for Brazil. |
