A declaração universal dos direitos linguísticos como política linguística para as pessoas em situação de refúgio no Brasil

Abstract

This research is an interdisciplinary study focused on Linguistics and Law, covering the theme of Language Policies and Linguistic Rights, its main purpose is to analyze the possibility of protecting the right to language of people in refuge situation in Brazil. In this sense, the question proposed as a problem to be explored in this research consisted of knowing whether the Universal Declaration on Linguistic Rights (DULR) constitutes a possibility of language policy for people in refugee situations in Brazil, the general objective was the analysis of the DULR as an instrument that enables the protection of the language rights of people in Refuge. To answer these propositions, we established a deductive research methodology, that is, starting from problematizations and general hypotheses to discover a specific understanding. As it is a bibliographical and documental research, given that for the elaboration of the chapters it was necessary to go through a theoretical support that would provide the main concepts about Language Policies and Linguistic Rights, in addition to consulting the report with data on the refuge in Brazil and the text of the DULR. As a result of the research, we understand that the text of the DULR is representative with regard to Language Policies in defense of the rights of people in refuge situation in Brazil, given that in the analysis of the text, we observe that in many articles, the characteristics language policies practiced (actual practices of language use in a given community or society), declared (guidelines or official regulations established by government authorities or institutions responsible for formulating policies) and perceived (attitudes and perceptions of people towards languages and their policies. They may vary according to individual factors, such as ethnic, political, or cultural identity, as well as according to social and historical factors), as we analyze, mainly, from articles 16, 17 and 18 of the mentioned Declaration. By contrast, the need for legal initiatives to protect these rights also became clear, given that the existing support consists of the adoption and interpretation of the DULR to guarantee the right to language. In addition, other research can be undertaken, giving greater prominence not only to the topic addressed in this work, but also boosting the theme of Linguistic Human Rights among other topics involving an interdisciplinary approach of the researched areas.
