| Resumo: | A população negra brasileira se insere em um contexto de discriminação sistêmica com fundamento em raça, ou seja, racismo e que no país constitui elemento estruturante que atravessa todas as instituições e relações da sociedade e que ganha contornos maiores quando se trata do sistema de justiça criminal, pois vai além de sua reprodução ao ressignificar, reconstruir e reconfigurar a opressão com fundamento em uma hierarquia de raças e que extermina vidas negras dentro do aparelho de justiça criminal. Diante disso, visualizamos índices alarmantes de encarceramento em nome do combate às drogas e também uma sobrerrepresentação dos negros no que concerne às vítimas de homicídio que são 75,7% e quando vítimas de letalidade policial o número salta para 79,1%, enquanto constituem 55% da população brasileira. Em assim sendo, o objetivo do trabalho é analisar o racismo estrutural reproduzido pela “guerra às drogas” à luz de uma perspectiva teórica crítica. Para tanto, a metodologia utilizada foi a revisão da literatura, a partir do levantamento de bibliografia e documentos atinentes à temática. Partimos de uma análise de como o racismo é elemento estruturante da sociedade brasileira, para construir a base do trabalho e do problema de pesquisa. Após, os problemas que giram em torno da “guerra às drogas” e como esta tem seus alvos delimitados e destrói direitos e garantias fundamentais. Por fim, uma investigação filosófica que vem a explicitar a problemática do trabalho através da teoria necropolítica, visto que se tem uma política que provoca a morte em larga escala. A conclusão a que chegamos é a de que nunca houve uma real tentativa de romper a estrutura racializada do país, de forma que o sistema de justiça criminal sempre ocupou lugar central em conservar a estrutura intacta, já que a partir do momento que os negros deixam de ser propriedade dos seus senhores é o direito penal que passa a controlar o corpo negro e ainda hoje o faz por meio de uma “guerra às drogas” que muito pouco tem relação com diminuir ou acabar com o consumo de drogas, portanto somente serve de eufemismo para uma política de extermínio. Dessa forma, é preciso compreender que o racismo é um problema real e estrutural e que a “guerra às drogas” exerce um papel crucial na manutenção de uma estrutura racista e na política de morte da qual a população negra é alvo. |
| Abstract: | The brazilian black population is inserted in a context of systemic discrimination based on race, that is, racism and which in the country constitutes a structuring element that crosses all the institutions and relations of society and when it comes to the criminal justice system it goes beyond reproduction to reframe, rebuild and reconfigure the oppression based in a hierarchy of races that is exterminating black life inside the criminal justice system.Thus, we see alarming incarceration rates in the name of the drug war and also an overrepresentation of blacks in relation to the murder victims are 75.7% and when victims of police lethality number jumps to 79.1%, while they are 55% of the Brazilian population. Consequently, the objective of the work is to analyze the structural racism reproduced by the “war on drugs” in a critical criminology perspective. For that, the methodology used was the literature review, based on the survey of bibliography and documents related to the theme. We start from an analysis of how racism is a structuring element of Brazilian society, to build the basis of work and the research problem. Then, the problems surrounding the “war on drugs” and how it has its targets defined and destroys fundamental rights. Finally, a philosophical investigation that explains the problem of work through necropolitical theory, since there is a policy that causes death on a large scale. The conclusion we reached is that never happened a real attempt to break the country's racialized structure, so that the criminal justice system has always played a central role in keeping the structure intact, since from the moment that black slavery was abolished the criminal law starts to control the black body and even today it does through the “war on drugs” that has nothing about reducing or ending drug use, so it only serves to euphemism for an extermination policy. Therefore, it is necessary to understand that racism is a real and structural problem and that the “war on drugs” plays a crucial role in maintaining a racist structure and in the death policy of which the black population is targeted. |
