CRIME SILENCIOSO: UMA ANÁLISE SOBRE O CRIME DE VIOLÊNCIA PSICOLÓGICA CONTRA A MULHER E A DIFICULDADE DE IDENTIFICAÇÃO

Abstract

The present work has the scope of carrying out a study on the effectiveness of the application of existing laws in the Brazilian legal system regarding the crime of psychological violence against women. Thus, the main objective is to analyze the definitions of psychological violence and how they occur in cases of violence against women in order to identify whether the legal advances made to date are sufficient to fulfill the gap that exists in the identification of this crime. With such purpose, the following specific objectives were prioritized: to analyze the social structure and the way in which society sees the role of women; To clearly define the concept of “psychological violence”; To analyze the consequences generated by exposure to this type of violence; To construe law 14,188/2021 and law 11,340 (Maria da Penha); To identify whether the current legal system is able to deal with psychological violence against women. Dogmatic-instrumental method will be used for data gathering, with a descriptive approach and research of bibliographic and documentary procedures. Therefore, after the end of this research, it was possible to understand that only the typification of the crime of domestic violence against women is not enough to support the victims of this misdeed, requiring a greater interdisciplinarity act between law and psychology, so that there is proper treatment of the reported cases, with due method resulting in the correct punishment of the aggressors.
