O PLANEJAMENTO DAS CONTRATAÇÕES PÚBLICAS NA NOVA LEI DE LICITAÇÕES E CONTRATOS ADMINISTRATIVOS, LEI 14.133/2021: UM ESTUDO ACERCA DAS NORMAS ESPECÍFICAS ELABORADAS PELO ESTADO DA PARAÍBA

Abstract

This monograph addresses the aspect of planning in the New Public Procurement and Contracts Law (NLLC), Law Nº. 14.133/2021, and discusses the regulations developed by the State of Paraíba., using its regulatory power, standardized such planning aspects through its specific standards in compliance with the general standards provided for in the new law. Firstly, the way in which the NLLC approaches planning as an explicit principle is discussed, as well as the planning and governance instruments that will become the rule after its definitive validity in isolation. Next, the next step involves an investigation into the federal regulations that regulated planning instruments after the NLLC came into force, based on the federal government's website. Finally, in the third moment, the existing regulations regarding planning before and after the NLLC are listed , as well as the vision of the related secretariats of the executive branch extracted through questionnaires with their main public agents. To this end, the research techniques employed were predominantly of a legal, documentary and bibliographic nature, involving the study of doctrine, legal articles, online learning resources, government electronic websites and records of legislative processes, as well as field research by through the application of semi-structured questionnaires to public actors who work at the strategic government level in departments related to the topic addressed. For all of the above, it was found that, despite the existence of some regulations regarding the planning instruments listed in the present study, the state of Paraíba needs to move even further towards producing its specific standards so that there is local effectiveness in application of the NLLC and, therefore, the entire society reaps the fruits recommended in the new legislation.
