Migrações transnacionais: a inserção do trabalhador migrante em situação de vulnerabilidade socioeconômica como fenômeno propulsor do dumping social

Abstract

The advent of globalization has given a new meaning to individual interactions at a regional and global level. The intensity of the exchange of information and technologies and its flow of people and capital provided the creation and addition of new subjects and events that are not resolved satisfactorily, including migrations, the social situation and the work of the migrant. Therefore, the notion of transnationality is discussed, as a proposal for the resolution of present and future events and Transnational Law as a regulatory instrument. The specificity of the study demands the mention and interpretation of the rights of migrant workers, from the recognition of the right to migrate and the norms pertaining to this social group, forming the framework of guarantee and protection. Social dumping is also analyzed as a practice that violates rights, as it seeks to profit large companies at the expense of violating labor rights. The deductive method will be used in the research and data processing phases. In the different phases of the research, the techniques of referent, category, operational concept, bibliographic research and registration will be used. The development of the theme will guide the pursuit of general and specific objectives that will guide the production. The research will end with the final considerations and will substantiate the result of the findings, ending up confirming the initially conceived hypothesis, in order to verify that the insertion of migrant workers in a situation of socioeconomic vulnerability is a driving force behind social dumping, considering that it is necessary to prohibition of this conduct for the achievement of fairer commercial and labor relations.
