O tráfico de pessoas para fins de exploração sexual relido à luz da teoria do domínio do fato no contexto das organizações criminosas

Abstract

The present work aims to analyze the criminal type of human trafficking, foreseen in art. 149-A, of the Penal Code, based on the principle of human dignity, bringing not only a discussion about its constitutive elements, but also to discuss the historicallegislative evolution of that type, highlighting the main applicable legal and international provisions, emphasizing Law 13.344/2016 and the Palermo Convention, in order to contextualize it with the main political-doctrinal discussions regarding the elements that compose it. The deductive method will be used in the research and data processing phases. In the different phases of the research, the techniques of referent, category, operational concept, bibliographic research and registration will be used. The development of the theme will guide the pursuit of general and specific objectives that will guide the production. The research will end with the final considerations and will substantiate the result of the findings, ending up confirming the initially conceived hypothesis, it will also be intended to correlate the referred criminal type with the theory of the domain of the fact in order to problematize it within the scope of criminal organizations.
