Abstract

The present study aims to analyze the difficulties faced by oncological patients due to the bureaucratic dysfunction of the state. Thus, throughout history, we have observed the gradual construction of the right to health in various parts of the world, especially through the recognition of social rights and their normative consolidation in Brazil, starting with the promulgation of the Federal Constitution of 1988. In this context, the creation of the Unified Health System (SUS) stands out as a relevant public policy aimed at ensuring universal and equitable access. The study raises questions about the separation of powers as a dissonant limitation and the jurisdiction each entity has over health matters. Additionally, it emphasizes a brief historical concept of bureaucratization, the criticisms perpetuated on the subject, and the excesses that bureaucracy can cause, as the word is widely associated with a negative connotation, suggesting inefficiency, excessive formalism, and the creation of unnecessary methodologies within Public Administration. It also discusses the challenges faced by the bureaucratic dysfunction of the state and its implications for the lives of cancer patients and the healthcare system. The study was developed using the deductive method, starting from general ideas and concepts to specific ones. Furthermore, bibliographic research was conducted by collecting information from scientific articles, books, dissertations, and theses on the proposed topic, as well as research on legal documents such as legislation and resolutions. Finally, the study concluded that while bureaucratization is necessary, its dysfunction poses a problem for the effective realization of the social right to health for oncological patients.
