| Resumo: | O presente trabalho aborda a questão da Reforma Trabalhista de 2017 - Lei 13.467/17, discutindo seus principais pontos e determinando quais as perspectivas sindicais decorrentes dessa alteração legislativa. Fica evidente, pois, o grande interesse público na demanda em questão, uma vez que a luta por direitos trabalhistas é matéria recorrente na história. Desde a Revolução Industrial, quando ocorre a divisão de classes, que o proletariado, os trabalhadores, em geral, lutam por direitos e melhores condições de vida e de trabalho. A partir da análise do início do movimento sindical até os dias atuais, é perceptível que muitos foram os diplomas legais que abrangiam as questões trabalhistas. Ora favorecendo mais a classe operária, ora a classe patronal. Partindo deste pressuposto, o presente trabalho tem o objetivo de analisar como as mudanças legislativas trazidas pela Lei 13.467/17 irão afetar as relações de trabalho, bem como a reação dos sindicatos e organizações sindicais como um todo, diante de tantas mudanças prejudiciais à manutenção da sua estrutura atual. A Reforma em questão gerou e, ainda gera, grande polêmica na sociedade brasileira, dentre os desafios abordados por ela, destacam-se dois: o fim da contribuição sindical e a primazia do negociado sobre o legislado. Para a maior parte da população brasileira essa nova lei significa um retrocesso para o país, uma vez que passa a dar mais poder à classe patronal a partir do momento que determina que o negociado terá força de lei. A partir disso foi utilizada pesquisa bibliográfica, através de artigos, doutrinas, notícias e leis que tratassem do assunto. Partindo da análise de tais documentos foram expostos alguns dos entendimentos sobre o tema, demonstrando os pontos positivos e também os negativos da nova lei e demonstrando, ainda, as perspectivas para a seara sindical. Portanto, a obra visou, acrescentar à sociedade informações sobre o tema e mais um ponto de vista acerca de uma assunto que gera tanta polêmica e controvérsia na realidade brasileira. |
| Abstract: | This work addresses the 2017 Labor Reform – Lei nº 13.467/17, discussing its main topics and analyzing the perspectives for the labor unions with the new legislation. The strong public interest in this subject is evident, as the struggle for labor rights is recurrent in history. Since the Industrial Revolution, with the classes segmentation, the proletariat and workers in general fight for their rights to a better work and life conditions. Throughout an historical analysis of the labor union movement from its beginning until nowadays, it is possible to conclude that many were the legal instruments addressing labor issues. Some were more beneficial to the working class, and some leaned towards the employees’ interests. Based on this assumption, the present work aims to analyze how the legislative changes introduced by the Law nº 13.467/17 will affect work relations, as well as how the labor unions and organizations will be impacted by the many changes that were prejudicial to them. The Reform in question caused and stills causes great controversy amidst the Brazilian society. Amongst the emerging challenges brought by the new law, the two following can be highlighted: the end of the union contribution and the preference of the negotiated over the legislated. To most of the Brazilian population, this new law represents a step backwards, as it gives employees more power by determining that what is negotiated between employees and employers acquires force of law. Based on that, it was used in this work bibliographic research, such as academic papers, legal doctrine, news, and legal documents addressing the subject. From an analysis of those sources, were presented some understandings about the subject, showing the positive and negative sides of the new law and indicating the perspectives for the labor unions. Therefore, this work sought to bring to society information about the Labor Reform and to present another point of view about this topic that stirs polemic in Brazilian reality. |
