| Resumo: | O presente estudo tem por escopo analisar, sob a ótica da cidadania por meio do trabalho, a Lei nº 13.467/17 que consubstancia a maior reforma trabalhista vivenciada pelo ordenamento jurídico brasileiro. Para tanto, serão objeto de exame os preceitos da cidadania e como estes são construídos através do trabalho, isto é, terá como objeto os elementos que compõe a cidadania, quais sejam, o civil, o político e o social, dando ênfase a este último, uma vez que o labor proporciona o desenvolvimento do caráter social da cidadania. Afora isto, será posto em análise, o progresso dos direitos sociais, especificamente, na conjuntura brasileira, salientando as suas peculiaridades ante ao processo típico de conquista dos direitos sociais. Será vislumbrado, ainda, a efetivação da cidadania através do direito ao trabalho, ou seja, o trabalho será alocado como fator integrador e emancipador da sociedade. Por fim, destaca-se o contexto de crise econômica nacional que alicerçou e estimulou a aprovação da Lei 13.467/17, como também, faz-se um estudo das alterações decorrentes da referida reforma trabalhista, evidenciando que esta atende ao fenômeno da flexibilização e precarização trabalhista. Nesta senda, faz-se o seguinte questionamento: Quais os efeitos da Lei 13.467/2017, que consolida a reforma trabalhista brasileira, no projeto constitucional de cidadania social pelo trabalho? Para responder, será empregado o método de pesquisa hipotético-dedutivo, possuindo como ponto de partida um estudo geral da cidadania, passando por seu atributo social e sua relação com o avanço dos direitos sociais, para, posteriormente, analisar a Lei 13.467/2017 e seus efeitos na concretização da cidadania pelo trabalho. Quanto aos métodos de procedimento, a pesquisa se dá de forma estatística, histórica, monográfica e comparativa. Além disso, utiliza-se a pesquisa documental indireta, através da revisão bibliográfica, por meio do qual se levará em consideração a relação da cidadania com o direito ao trabalho, partindo do pressuposto que este é fundamental para a concretização plena daquela e reputando relevante a eficácia dos direitos humanos para a realização da cidadania. |
| Abstract: | The purpose of this study is to analyze, from the point of view of citizenship through work, Law 13.467/17, which constitutes the greatest labor reform experienced by the Brazilian legal system. To do so, the precepts of citizenship will be examined and how they are constructed through work, that is, it will have as its object the elements that make up citizenship, namely civil, political and social, with emphasis on the latter, since the work provides the development of the social character of citizenship. Aside from this, the progress of social rights, specifically, in the Brazilian context, will be analyzed, emphasizing its peculiarities before the typical process of conquest of social rights. It will also be seen the effectiveness of citizenship through the right to work, that is, work will be allocated as an integrating and emancipating factor of society. Finally, the context of the national economic crisis that underlies and stimulated the approval of Law 13.467/17 is highlighted, as well as a study of the changes resulting from the aforementioned labor reform, evidencing that it attends to the phenomenon of flexibilization and precarization labor market. In this path, the following question is asked: What are the effects of Law 13.467/2017, which consolidates the Brazilian labor reform, in the constitutional project of social citizenship for work? In order to answer, the hypothetical-deductive method of research will be used, starting from a general study of citizenship, passing through its social attribute and its relation with the advancement of social rights, and later analyzing Law 13467/2017 and its effects on the realization of citizenship through work. As for the methods of procedure, the research is done in a statistical, historical, monographic and comparative way. In addition, indirect documentary research is used through a bibliographical review, which will take into account the relationship between citizenship and the right to work, based on the assumption that it is fundamental for the full realization of that and considering it relevant effectiveness of human rights for the realization of citizenship. |
