A violência psicológica contra a mulher no âmbito da violência doméstico-familiar sob a perspectiva das teorias feministas do direito

Abstract

The present work aims to analyze psychological violence against women in the context of domestic-family violence from the perspective of feminist theories of Law. This study was carried out through bibliographical research, through the consultation of books, scientific articles, national and international academic works, audiovisual media of National Congress hearings, and jurisprudence. The focus is on the home as the main place of aggression, the partner as the main aggressor, as well as the complexity and perversity of the process of psychological violence and its strategic use to control the victim. As well as the unprepared way in which the Law has dealt with psychological violence was analyzed, as well as the enactment of Law No. 14.188 / 2021 and the possible impacts - oppression and facilitation of complaints - of the validity of this law. Thus, the importance of recognizing, in the legal sphere, psychological violence and questioning the need for its insertion in the penal system, as well as the need to use alternative measures to combat violence, is observed.
