OS CAMINHOS PARA A EFETIVAÇÃO DOS DIREITOS SOCIAIS NO BRASIL: COMPORTAMENTO DECISIONAL DO SUPREMO TRIBUNAL FEDERAL NAS DISPENSAS EM MASSA DOS TRABALHADORES

Abstract

The social rights built on the principle of human dignity are the main guideline of the Federal Constitucion of 1988. The work is organized into section beginning with the introduction and the chapters that address the constitucional parameters in order to guarantee Social Rights, exposing the dignity of the human person. As a result, it lists the problems resulting fron the advance of neoliberalism and the mitigation of labor rights caused by Law 13.467//2017 of the labor reform, this study sought to analyze in particular the changes that triggered the exclusion of the need for union participation in the scope of negotiation collective bargaining and how this is reflected in the brazilian legal system, especially in the lives of workers. The search for the application of constitucional ideals take place through the realization of these principles in the lives of individuals. From the analysis of these basic notions, we will seek to study the decision-making behavior of the STF that maintains negotiation as a reference, emphasizing the dignity of the human person, appreciation of work and the search for full employment. Furthermore, it will seek to reflect on the construction of a cnstitucional system through the interpretation and realization of social rights through the jurisprudence of the Federal Supreme Court.
