AS IMPLICAÇÕES DA TRANSGENERIDADE: UM ESTUDO DE CASO SOBRE O REGISTRO TARDIO DE UMA MULHER TRANS EM SITUAÇÃO DE RUA

Abstract

The present work aims to analyze the implications of transgenderism in the face of a system grounded on sexual binarism, observing both the legal and social spheres. Based on the conceptualization of transgenderism and its mapping in society, it is possible to identify a series of violations of rights in the lives of people who make up this spectrum, from the right to life to the right to work. It observes the legal transformations brought by judicial decisions and legislative changes, which had the intention of recovering or guaranteeing certain rights for this part of the Brazilian people. Given this panorama, it becomes feasible to analyze in a practical way the implications and transformations in the case of Isabela (fictitious name), a trans woman living on the street, whose civil birth registration had never been settled, a situation that resulted in a late registration lawsuit along with the Public Defense and which faces the slowness and insensitivity of the Justice System with the purpose of recovering both Isabela’s status of citizen, and her dignity as a person
